Terms governing use of this website.
These Terms of Service ("Terms") govern your use of the Education Choice Fund website at educationchoicefund.org (the "Site"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. About ECF
Education Choice Fund ("ECF") is a 501(c)(3) public charity (EIN 42-4473313). ECF intends to apply to become a Scholarship Granting Organization under IRC § 25F for the 2027 calendar year. ECF is not yet on Tennessee's list of scholarship granting organizations.
The Site provides information about ECF's program and accepts expressions of interest from prospective donors, families, and schools. The Site does not currently accept donations or scholarship applications.
2. No Tax or Legal Advice
ECF is not a tax advisor, financial planner, or law firm. Information on the Site about IRC § 25F, Tennessee's Education Freedom Scholarship Act, scholarship programs, or related topics is provided for general informational purposes only and is not tax, legal, or financial advice. You should consult your own qualified advisor before making decisions based on tax credits, scholarships, or other matters discussed on the Site.
3. Forward-Looking Statements
The Site contains forward-looking statements about ECF's plans and program timeline. These projections reflect ECF's current expectations but are subject to change based on regulatory developments, donor participation, school recruitment, and other factors. Actual results may differ from projections.
4. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with anyone else's use
- Submit false or misleading information through any form on the Site
- Attempt to gain unauthorized access to any part of the Site, server, or database
- Use the Site to send spam, malware, or unsolicited communications
- Scrape, mirror, or republish Site content without ECF's written permission
5. Intellectual Property
All Site content (text, design, graphics, layout, and code) is the property of ECF or its licensors and is protected by copyright and other intellectual-property laws. You may share short excerpts with attribution. Reproduction of substantial portions, distribution, or commercial use requires ECF's written permission.
6. No Warranty
The Site is provided "as is" and "as available." ECF makes no warranties, express or implied, regarding the Site, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. ECF does not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
7. Limitation of Liability
To the maximum extent permitted by law, ECF and its founder, board, people who serve ECF without pay, and service providers shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site, including any reliance on information provided on the Site. ECF's total liability for any claim relating to the Site is limited to $100.
8. Third-Party Links
The Site may contain links to third-party websites (such as the IRS, the Tennessee Department of Education, or partner schools). ECF does not control these sites and is not responsible for their content or practices. Your use of third-party sites is governed by those sites' own terms and privacy policies.
9. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Site shall be resolved in the state or federal courts located in Williamson County, Tennessee.
10. Changes to These Terms
ECF may modify these Terms at any time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
